Hasbro Fails To Get Injunction On ASUS Transformer Prime

Transformer Prime: Hasbro’s hip toy or an ASUS tablet? That’s the confusion toy maker Hasbro hoped to eliminate when it set out to bar sales of ASUS Transformer Prime in a lawsuit filed last year. Today however that seems to be settled, as PaidContent reports that the judge has come back with a ruling, saying that Asus is clear to sell the tablet. The judge didn’t think that the name would cause confusion:

“There is nothing gimmicky about the Eee Pad Transformer or the Eee Pad Transformer Prime, nor can it be said that there is any similarity in the use or function between Hasbro and Asus’s products.”

The fact that the Transformer Prime transforms between a laptop and tablet primarily helped sway the court in their decision. So the good news is ASUS will be able to continue selling their $499, 10.1-inch Tegra 3 autobot tablet.

I’m with the judge on this one. I don’t think the Transformer Prime name would affect toy sales. What do you think?
