Google VP Says Apple Winning Against Samsung Was A Wakeup Call

“We didn’t believe rounded corners were patentable.”

Google was blindsided when Apple won its lawsuit against Samsung, which was really a proxy war between Apple and Google, because if Apple can defeat Google’s Android OEMs, they’ll win the battle against Google.

In an interview with Bloomberg TV, David Lawee, VP for corporate development, says that Google hopes that they are over the hump in the thermonuclear war, and he also admits that Apple winning the lawsuit was a big wakeup call. Watch the clip below for the full details.

If this guy can’t see all Samsung Apple rip-offs devices and thing that it was only a matter of “round corners and rectangles” im going to keep asking to myself how it’s possible this guy being a VP from such big company like Google.

    • http://www.facebook.com/people/Patrick-M-Phillips/1591990393 Patrick M Phillips

So, I take a flat, round board, put 3 legs on it, and call it a stool. Should I now be able to patent it and sue anyone who tries to take my basic design, slap a cushion on it or whatever, and profit off it? Should I be the government enforced, monopoly provider of “stool” technology for 100 years? Really?

      • http://twitter.com/int3nsive Int3nsive

The shape is the only way to describe a design, on a patent. But we all know that was not about shapes (round corners and rectangles) but about a shameless rip-off.

You can take a look in many other devices, like the Nokia Lumia and even the Samsung Galaxy S3… both are rectangles and have round corners, and Apple didn’t sue them. Because they don’t look like a iPhone.

After seeing this huge list, it’s stil hard to see why Apple sued Samsung, and won?

        • The__Truth__Hurts

There is only one and only one purpose of that list. To PROVE that Samsung is copying Apple. That’s it. Truth? Who cares about the truth, that is thrown out completely with that list.

Why don’t you have a list that shows EVERYTHING…? But wait, that will (quite literally) destroy the purpose of this list, down to every single point.

This is as bad as those list that shows that everybody “copied” Apple, yet it forgets to put All the devices that Apple looks SIMILAR to. (or Apple copied off)

          • http://twitter.com/int3nsive Int3nsive

There’s a HUGE difference between SIMILAR, COPY and Inspired by.

And when we talk about copies, is when both brands sell the exact same devices and try to compete on the same market.

Inspiration is when you see a great design and bring that design to a device that has a different porpose from the one who you get inspired by.

A rip-off is when you see a device, and make a device with the exact same purpose using the same design. So yes, it’s time to people stop confusing (most of the time, on purpose) those definitions.

          • The__Truth__Hurts

Of course there is a huge difference. But suddenly when it’s NOT in you favor you want to “twist” it around.

For example those photos that show phones/tablets before the iDevice and after the iDevice. You (general you) want to claim that (Everybody) is copying off Apple. But when the “truth” is shown, that there were countless of devices that Apple “copied” off, suddenly it is screamed that is something different.

Weird Product-Apple product-Apple copies: OMG!!!! Everybody is copying off Apple!!!

            Product-Apple product is a “copy”-Show products: OMG!!! That’s not true. That’s different!!!

funny, how it’s (suddenly) twisted when it’s not in Apple’s favor.

That link is so horribly biased. The usb power plug? That same exact design is found just about everywhere. Oh and the iPad and Samsung tablets look similar? We’re talking about a flat device that has a screen on it. Tablets are limited by screen dimensions and all of the manufacturers use relatively standard screen sizes. Calling those similar because of that is stupid. There are so many Apple fanboys in here posting. You do realize the ONLY reason Apple one that case was because the jury was completely inept? They didn’t even read the full jury instructions before making a decision. They incorrectly penalized Samsung for a product they ruled didn’t infringe. They admitted that they tried to penalize Samsung, which is against the law, instead of compensating Apple for damages. They completely ignored prior art (aka all of the devices that had the technology that Apple stole and then claims patents over such as pinch to zoom.) Google had voice features before Siri. Please intelligently show how S-Voice copied Siri. Do they use some sort of special algorithm or do you think that all voice searching is owned by Apple? Apple developed their proprietary docking cable. The industry since came up with a standard docking cable (the PDMI) that looks similar. Samsung uses a similar connector but made the cables proprietary so that they could monopolize accessories just like Apple does, a practice in the tech industry going back for decades. Just because it looks like an Apple cable, doesn’t mean shit. Half the things people in here are claiming Apple created and Google stole were present on Windows Mobile phones. Just because Steve Jobs didn’t force feed you it in an unveiling doesn’t mean it didn’t exist beforehand. The smartphone I had that was two years old when the first iPhone came out had better specs then the iPhone.

          • http://twitter.com/int3nsive Int3nsive

Samsung rip-off almost every Apple device. Period. If you can’t see that, even with all those evidences out there, you should check the ophthalmologist

    google was blindsided by apple…?
apple was blindsided by google when a former apple board member and google ceo oversaw android adopt overnight something remarkably similar to iOS.

“We didn’t believe round corners were patentable.”

–This is purposeful evasion and a blatant attempt to divert attention from what Eric Schmidt and his team actually DID copy: The all-screen/no physical keyboard concept, the OS layout and icons, the overall look, feel and operation of the OS. It’s maddening to hear this smoke and mirrors PR campaign to make it look like Google and Samsung did nothing wrong. Compare the Android OS to a current Windows phone. They look nothing alike except for the shape of the phones themselves. Now compare the Android OS and the iPhone OS. They look nearly identical.

    • Daniel Blackburn

You obviously haven’t used a recent android device then. The differences far outweigh the similarities, not to mention the fact that apple copied androids notification pull down in IOS 5.

      • http://www.facebook.com/profile.php?id=1268403284 Nick Hansen

the idea is that android got to where it is now by copying apple, whether they are or not now.

      • http://twitter.com/int3nsive Int3nsive

Notification bar is a open-source solution that Android adopted first and iPhone after. But none of them own the patents. Because if Google owned the patents over the notification bar, they probably sued Apple without a doubt. And would be fair if they won.

I remember using Cydia, before the Android public release, and using a similar feature. So, since Android live from the open-source community, they grab that idea too. Android is a miscellania of ideas taken from other OS’s, from the iPhone to the old Windows Mobile and even Symbian. They even used JAVA codes that they aren’t allowed to do and got sued by Oracle. So yes… Google did a dirty job to build Android. And the most epic was having a BB wannabe and suddently, a IOS wannabe. Now they get features and features, most of them unstable and on beta stage. That’s why the performance of Android suck hell and the same for stability. The main reason why Android devices need dual core or even quad core to run fast and smooth like the iOS does with just only one core.

I am completely blindsided, Morons can become VPs @ Google!

  • SamuelBrock

I find it funny that only Apple fans have commented on this post on Cult of Android. As a fan of both OS’s, and someone who loves to hate Samsung, I think Android is the solution to the problem and All OEMs need to go with Google’s stock solution.
My problem with this video is that the VP is running through Google’s PR crap about rounded rectangles when if you get down to business, the evidence was clear. Not necessarily about Android, but about Samsung.

I can’t believe how many are caught up in this ridiculous, artificial, government-created construct called patents and IP. Using the coercive power of the State to crush your competitors is sickening.

I’m a HUGE Apple fan and have a great deal of respect for the company, but these lawsuits need to stop. Apple’s products are iconic and any attempt to “copy” their designs will be seen by the public as just that, a copy. Who fucking cares!

There IS no IP in the fashion world and recipes can’t be patented. Just imagine how horrible football would be if you could patent a play! IP stifles progress and competition, and encourages stagnation. The protection of your brand image is to simply get there first. How does Coca-Cola guard its formula? NOT with the force of gov’t. It guards its recipe. Are there a dozen knock-off brands that taste almost the same? Yes. But guess what, you still buy Coke. Does your wife want the bag that looks pretty much exactly like a Coach bag, or does she want the ACTUAL Coach bag.

The Wright brothers were first in flight and spent the rest of their days, bankrupting themselves, fighting anyone else who dared try to take their model and improve on it. Patents are anti-progress and anti-civilization. They’re gov’t granted monopolies. I wish Apple would abandon this ridiculous waste of time, money, and resources, for the sake of all of us!

    • http://twitter.com/int3nsive Int3nsive

There’s no problem selling similar soda. Probably the formula is different on both, since they all claim “secret formulas” and they taste different.

The problem is when a brand try to be other brand. It was like Pepsi using the same font type as Coca Cola, same colors and mimicking Coca Cola in almost everything.

And now some VP presisent saying that “It’s a shame that Coca Cola can have a patent around font types and the red color that they use as backround”.

      • The__Truth__Hurts

There IS a problem when someone rips it off someone else beforehand and then try’s to claim that others are ripping of them.

        • Daniel Blackburn

I agree with this completely. Apple has never really invented anything on it’s own. It keeps a look out for things that look promising and then they go buy whoever it that is making the product.

      • http://www.facebook.com/people/Patrick-M-Phillips/1591990393 Patrick M Phillips

This is the whole point. IP is an artificial construct. It’s not about “property” in the true sense of the term. It’s about monopoly privilege and protectionism. You cannot “own” an idea, any more than you can own the air.

Does anyone SERIOUSLY pick Samsung products because they believe them superior to Apple’s, or just as good as Apple’s? No, it’s to save a few bucks and get something sorta-kinda like Apple’s. If they’d had IP at the dawn of civilization we would’ve HAD no civilization as the inventor of the ox-drawn plow or wheel would’ve prevented anyone else from copying his design and improving on it. Civilization would’ve come to a grinding halt!

In a free society you compete. You beat your competitors in the court of public opinion as consumers vote with their dollars on which products offer the best quality at the best price.

In this bullshit world of gov’t manipulated EVERYTHING, you destroy your competition by use of a hired, proxy army, i.e. legislatures, patent offices, and judges.

        • Daniel Blackburn

Are you kidding me? I don’t care if Samsung’s products are cheaper. I like them better because they are better. They are open, they encourage creativity. If I want to put a different ROM on my galaxy tab I can. I can connect a keyboard and mouse, a game controller, plug in an sd card, OUT OF THE BOX. This made the choice between the ipad and my galaxy tab a simple one. I bought the one that was more useful. And obviously that was the samsung. Apple crushes creativity and hates competition. The samsung galaxy III had over 9 million preorders. Not because people wanted to save money, but because it was a better device. I know countless people that are fed up with apple and have switched to android, and they love it. Apple fans are way to close minded and their mindset of superiority over those that can’t “afford” apple is shameful.

      • Daniel Blackburn

Explain how samsung is trying to be like apple? Samsung makes something comparable(by comparable I really mean better than) to all apple devices plus tv’s, blu ray players, printers, cameras, camcorders, the list goes on and on. Not to mention the fact that they are the second largest semiconductor chip maker, and they were making phones long before apple.

        • http://twitter.com/int3nsive Int3nsive

You should open your eyes then… because the list is huge. And yes, Samsung is cheaper than Apple because.

          1) Use cheap plastic
          2) They don’t spend money on research, since they copy the working models that others, like Apple, did.
          3) Since they are a manufacture, they can produce cheaper chips for them.
          4) They don’t spend money on the OS, because they use other company OS.
          5) They don’t care about support. People are always asking if the next major release will be available for their devices…
          6) Open? lol… Samsung is encripting the bootroom to avoid people from installing new ROM’s. Since Samsung make money on the hardware and not on the software, they will try everything to stop people from getting the latest updates.
          7) Copy is not innovation. And innovation is not invention. Apple is a innovative company, who can see the potential on technology never used before and make them availabe to everybody.

Apple didn’t invented the Multi-touch, but was the first company to make that technology mainstream and work fast and smooth, since the day ONE. Samsung are here almost 20 years and never did nothing about new technologies… they only follow the models that others do before them.

          • Daniel Blackburn

You’re just an ignorant prick. You are aware that apple gets many of the components for the iphone FROM samsung right? Samsung leads innovation in smart tv’s too. Your argument that samsung hasn’t invented anything is total crap. Samsung is way bigger than apple and the 1 billion didn’t hurt them nearly as bad as you think it did.

          • http://twitter.com/int3nsive Int3nsive

Keep living in the wonderland. Apple is the most valuable brand in the world and you say that Samsung is bigger than Apple… cannot describe how ignorant you are.

            Just Google it… Apple, n.1 .. Google, n.3 … Samsung… number… yes… keep searching fucktard.

“Samsung leads innovation in smart tv’s too”

Like Apple leads innovation on computer and smartphone world.

Samsung didn’t intented the TV, Apple didn’t invented the smartphone neither the computers… but seems to me that you are so ignorant that can’t tell the different between innovation and invention. Now GTFO.

          • Daniel Blackburn

There’s no point in continuing a conversation with someone as unintelligent as you. It says something about your intelligence level when you have to resort to profanity to get your point across. One last question though? Where does Apple lead innovation in computers? Samsung manufactures the “Retina” displays for ipads and macbooks. So if you’re referring to that as innovation on Apple’s part your wrong. Intel created thunderbolt, not apple, and many sony vaio laptops have thunderbolt ports on them. Most, if not all, of your arguments are invalid, and your lack of intelligence and your inability to actually research something is profusely bleeding through.

          • http://twitter.com/int3nsive Int3nsive

Where’s the Retina Display Samsung Laptops and Tablets?

  • The__Truth__Hurts

I’m a huge fan of Google. Love their products & services.

A lot of people claim that the reason Google isn’t patent heavy is because they just rip off everyone.

What do I have to say to you?
The reason why Google “hates” patents is that it destroyed/is destroying innovation. Patents were “founded” on the principal of PROTECTING the individual. PROTECTING THE INDIVIDUAL. They were designed so when someone “invented” something, nobody could rip off him.

    Nowadays?

Patents are not designed to product individual ideas. Patents are designed to KILL competition. Basically, A company can buy up patents or (simply) use patents to kill competition They aren’t being used to protect an idea, but rather to destroy competition. And the way the system is set up now, basically it’s not designed to PROTECT an idea, but rather to kill competition.

And What Google realizes, is that the system is screwed up. And the only way to “combat” the system is to go into the system and “destroy” it.

Apple vs Samsung? Apple is NOT going after Samsung to protect their “ideas”, but rather to KILL competition. And the outcome of the case? It’s surprising and not surprising. Surprising because, how the world can someone “win” a case where it’s (obvious) that so & so’s patents are basically invalid and/or that the devices are NOT infringing on them. But at the same time it’s not surprising because…. well… The stupidity of the american patent system/court system.

    • http://twitter.com/int3nsive Int3nsive

If Google is so “open mind” and think that protecting intelectual propriety it’s just wrong, why they don’t show us the Google algorithm then? And let other web search engines take advantage from their code and spread some “innovation” in this area?

Too much hypocrisy, don’t you think?

      • The__Truth__Hurts

There is stuff they needs to be protected. And then there is stuff that does not and people/company abuses it.

I’m sorry to break it to you, but Apple really is not that “innovative”. They may be the first to make it “popular”, but almost 99.99% of the time they were NOT the first to do it.

And what does Apple do? Try to sue everyone out of existence for stuff that they (literally) did not invent, but somehow got patents for.

Funny how other companies aren’t suing each other over “frivolous” stuff. But Apple? Oh, even a minor thing, they are going after.

        There is a difference.

        • http://twitter.com/int3nsive Int3nsive

“There is stuff they needs to be protected.” like the intectual propriety from any brand, that defines their identity. And if Apple is not allowed to protect their stuff… then Google should release the alghoritm from their own web-search…

What Samsung did with Apple was the lowest thing I ever saw in almost 20 years of tech experience. I mean, they are ripping off almost any Apple products and people still think that’s “cool” and “fair”?. Apple thought that it was time to stop that crap and say: enough! And They used everything they could to send that message to Samsung. Come on.. even inside documents from Samsung prove that Samsung is ripping off Apple.

Seriously, even almost brand in the world agree with Apple, most of them don’t say “out loud” because they are taking advantage from joining forces to Android, but I’ve already seen many ads from HTC joking about samsung rip-offs and even GOOGLE warned Samsung that some of their devices look like Apple devices.

Seriously, Google is a great company but is being so hypocrite at this moment, and probably because they are afraid what Apple can do to them, since Eric Shmidtz betrayed Apple. Google owns patents too and they bought Motorola to make their patent portfolio richer. What this guy is saying its just a big BS and making the things look like “silly” when there’s a lot of things that prove that Apple was right. Just take a look at the huge list of devices where Samsung ripped off Apple in almost any detail. It’s a shame and not innovative AT ALL.

          • The__Truth__Hurts

Oh. The design that COUNTLESS OF WORLD COURTS say that SAMSUNG IS NOT INFRINGING UPON APPLE DRESS/PATENTS/(the numerous other things that cover the design of device)?

Matter of fact, Samsung was found “infringing” upon Apple tablet design. Except the judge laughed at Apple and basically told Apple to stop copying prior art, because there were countless of PRIOR ART to bust Apple claim. So, even apple’s DESIGNS are blatant copies of other products/devices.

And that diagram…? Nothing new. companies are (constantly) tearing apart competitors devices, and finding ways to IMPROVE on what the competitor does. No wonder why Apple is trying to use litigation to get a head. They think they are so far superior to everyone they don’t need to do anything. Thus, everybody is passing them.

Samsung ripped off Apple? As much as Apple ripped off others.
