Apple has claimed final victory in a lawsuit arguing that the company was purposely intercepting and failing to deliver texts sent from iPhones to Android owners.
The case was related to Apple’s iMessage service, which posed a challenge to Apple-to-Android switchers up until 2014, when Apple finally issued a fix for the problem.
Judge Lucy Koh suggests the settlement should be considerably higher than the one offered by Apple and Google. They disagree.
Four tech giants, including Apple and Google, have attacked the decision of U.S. District Judge Lucy Koh for rejecting a proposed $324.5 million settlement over Silicon Valley hiring practices.
In a court filing made later on Thursday, Apple, Google, Intel and Adobe asked the 9th U.S. Circuit Court of Appeals to overrule Koh’s verdict.
Koh had rejected the proposed settlement, claiming the amount was too low.
Apple and Samsung will return to federal court in Silicon Valley today for the next round of their seemingly never-ending patent war.
The two rivals will face off once again before District Court Judge Lucy Koh, presiding in the California city of San Jose.
Koh was the same judge who presided over the previous Apple vs. Samsung trial, which ended with a jury deciding that Samsung owed Apple more than $1 billion in damaging for infringing on patents — although this number was later trimmed to $929 million.
Apple has today had its request for a permanent injunction on Samsung’s patent-infringing products denied. The Cupertino company was awarded $929 million in damages, but it argued that the monetary sum was insufficient, and that a number of Samsung products should be banned.
In latest news from the Samsung vs. Apple patent case, Samsung on Wednesday filed an emergency motion with presiding Judge Lucy Koh to halt Apple’s damages retrial.
Why the halt? Because according to court documents, the US Patent and Trademark Office has suggested that Apple’s “pinch to zoom” patent (which much of the patent trial revolves around) might not actually be valid.
